Claim compensation for your prejudice with LOT Polish Airlines

Lot Polish Airlines, the Polish national airline, has been flying since 1928. Today, it serves a network of more than 100 destinations, operating a fleet of 37 aircraft.

    My name is Ecaterina Stepaniuc. I am an assistant professor at Southeast Missouri State University. On August 6, 2021 my family and I were denied boarding the flight from Chisinau to Warsaw (LO 514), and as a result weren’t able to continue our trip from Warsaw to Chicago (LO 3). The LOT airport representatives in Moldova informed us that we were denied boarding because our passport visas didn’t qualify to enter the United States. At the check-in desk, we provided a full list of documents. Below is the list of documents we provided:

    I provided copies of all these documents in the attachments. The LOT Airport representatives made copies of all our documents and sent them to Border Control/Polish Representatives to inquire about our case. We waited for over 30 minutes for a response and were told we couldn’t fly.

    We believe this decision was mistakenly taken and ask that we are compensated for all the trouble and difficulties we had to go through. Here is why we believe we were wronged and should have been allowed to board the plane in Chisinau, and later continue our trip to Chicago:

    First argument: Since both, my husband and I hold a US Employment Authorization Card, we should have been allowed to board the plane and fly to the United States. This was confirmed to us by Veaceslav Sportco, the Profiling and Docs Control Handling Representative from Chisinau Airport the following day, August 7. When we returned to the airport on August 7, he investigated all our documents again and the moment he saw the US Employment Authorization Cards he said, you should have been able to fly.

    To add to this, Mr. Sportco decided to send copies of our documents to the Immigration Office and their representatives confirmed to us that we should have been allowed on board because we meet all required criteria. Moreover, after we contacted the US Embassy in Moldova and explained our case, once again they indicated that we should have been allowed to board the plane and finalyze our trip because of our US Employment Authorization Cards. This was confirmed to us via a phone conversation on August 7. The US Consul explained to us through Alina Iovu Sandu, US Embassy representative, that after they analyzed our case, we should have been allowed to start and finalyze our trip to the US. The Consular Section suggested we send a letter to Department of Homeland Security Traveler Redress Inquiry Program.

    Second argument: Our son, George Joseph Bitco is an American citizen. According to President Joe Biden’s Proclamation on the Suspension of Entry as Immigrants and Non-Immigrants of Certain Additional Persons Who Pose a Risk of Transmitting Coronavirus Disease, Section 2, (IV) indicates that the entry suspension does not apply to any noncitizen who is the parent or legal guardian of a U.S. citizen or lawful permanent resident, provided that the U.S. citizen or lawful permanent resident is unmarried and under the age of 21.     Mr. Sportco read President Biden’s declaration and told us that we do qualify, and should have been allowed to fly to the US since we are the parents of a U.S. citizen that is under the age of 21.

    As such, it turns out we should have been allowed board the plane and fly to the United States since we have all the required documentation to do so. Moreover, Moldovan airport representatives confirmed on August 7 that right after the plane took off, they received a confirmation message from Border Control representatives indicating that we should have been allowed to board the plane, but since the plane was already on his way to Warsaw, they decided to leave the situation as it was. It’s extremely disappointing to find out that we could have been in the US on time time, but instead I am urged to write you this long letter and explain the nightmare we are going through.

    My family had to make new flight arrangements and purchase completely new flights which were extremely expensive. I attached copies of the new flights. When I called LOT Polish airlines and asked that they rebook our flight, they refused to help. Their explanation was that since we didn’t have all required documents to fly, the flight is automatically canceled and doesn’t qualify for reimbursements. We decided to make new travel arrangements since I have engagements at my job and I have to physically be located in the United States to meet my duties. Regarding our new flights, we were forced to spend a lot of money in order to be able to fly. There were only two tickets in the Economy department left. Since we are a family of three, we had to purchase a really expensive ticket in the business department so we can all return to the United States. Moreover, we had to make changes to our route – final destination New York. This brought even more expenses. We had to purchase new flights from New York to our home city, Cape Girardeau.

    This has been an extremely overwhelming and uncomfortable situation. I am pregnant in the third trimester, and going through such a stressful situation is not good for me or for the baby. I should also mention that we had to be tested for COVID-19 twice in three days. Going through this test is quite difficult for an adult, but seeing my three-year-old son be tested twice, crying and begging us not to do it again was heartbroken. I am only sharing this with you so you understand what we had to go through. Countless and expensive hours on the phone with LOT Polish airline representatives, long emails to my boss explaining my situation, extra visits to the Moldovan airport… all of these filled with worry, stress, and tears.

    I hope you understand that this situation wasn’t something we were prepared for. We hoped for a calm and enjoyable trip back to our home in the United States. Instead, we lived a terrible nightmare that cost us a lot of money.

    I ask that you investigate our case and reimburse all the money we spent for this trip. We had everything planned out and because of LOT representatives at the airport that didn’t let us board the plane when we had all documents required to fly, we had to go through an extremely difficult and expensive situation.
